Quelles sont les ressources disponibles pour r\u00e9duire au minimum les dommages sur l\u2019environnement? Comment les hydrocarbures r\u00e9cup\u00e9r\u00e9s sont-ils \u00e9limin\u00e9s en toute s\u00e9curit\u00e9? Qui paie le co\u00fbt du nettoyage et des dommages li\u00e9s \u00e0 un d\u00e9versement d\u2019hydrocarbures?<\/p>\n\n\n\n<p>Ce site a pour but de r\u00e9pondre \u00e0 ces questions, de fournir de l\u2019information objective sur le processus d\u2019intervention en place lors de d\u00e9versements d\u2019hydrocarbures par des navires commerciaux dans les eaux canadiennes \u2013 qu\u2019il s\u2019agisse de cargaisons ou de carburants \u2013 et d\u2019encourager des conversations \u00e9clair\u00e9es \u00e0 ce sujet.<\/p>\n\n\n\n<p>Ce site a \u00e9t\u00e9 cr\u00e9\u00e9 par le\u00a0<a href=\"https:\/\/clearseas.org\/fr\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Clear Seas<\/strong><\/a>, un centre de recherche ind\u00e9pendant \u00e0 but non-lucratif dont le mandat d\u2019hydrocarbures&nbsp;au Canada r\u00e9sultent de l\u2019\u00e9chouement ou de l\u2019abandon d\u2019embarcations de plaisance endommag\u00e9es qui laissent fuir de petites quantit\u00e9s de carburant ou d\u2019huile lubrifiante.&nbsp;Pour r\u00e9duire le risque que de tels d\u00e9versements se produisent, le gouvernement du Canada a mis en place diverses mesures, dont l\u2019adoption d\u2019une nouvelle&nbsp;<a href=\"https:\/\/laws-lois.justice.gc.ca\/fra\/lois\/W-12.3\/TexteComplet.html\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur les \u00e9paves et les b\u00e2timents abandonn\u00e9s ou dangereux&nbsp;<\/a>et d\u2019une&nbsp;<a href=\"https:\/\/www.canada.ca\/fr\/transports-canada\/nouvelles\/2018\/05\/strategie-nationale-relative-aux-bateaux-abandonnes-et-aux-epaves-au-canada0.html\" target=\"_blank\" rel=\"noreferrer noopener\">strat\u00e9gie nationale en la mati\u00e8re.<\/a>&nbsp;La plupart des d\u00e9versements d\u2019hydrocarbures provenant de navires commerciaux dans les eaux canadiennes sont \u00e9galement Canada<\/h3>\n<p>En 1970, le navire-citerne SS Arrow s\u2019est \u00e9chou\u00e9 dans l\u2019oc\u00e9an Atlantique pr\u00e8s de la Nouvelle-\u00c9cosse et a d\u00e9vers\u00e9 environ dix millions de litres de mazout, soit assez pour remplir quatre piscines olympiques et demie.<\/p>\n<\/div>\n                            <\/div>\n                        <\/div>\n                    <\/div>\n Pacifique<\/h3>\n<p>En 1988, 874\u2009430 litres de mazout \u2013 soit environ un tiers du volume d\u2019une piscine olympique \u2013 ont \u00e9t\u00e9 d\u00e9vers\u00e9s lorsqu\u2019un remorqueur est entr\u00e9 en collision avec la barge p\u00e9troli\u00e8re Nestucca au large des c\u00f4tes de l\u2019\u00c9tat de Washington. Les navires qui entrent dans les eaux canadiennes ou y transitent sont tenus d\u2019avoir, \u00e0 bord, un&nbsp;<a href=\"https:\/\/laws-lois.justice.gc.ca\/fra\/reglements\/DORS-2012-69\/page-5.html\" target=\"_blank\" rel=\"noreferrer noopener\">plan d\u2019urgence contre la pollution par les hydrocarbures&nbsp;<\/a>qui informe l\u2019\u00e9quipage des mesures \u00e0 prendre et des organisations \u00e0 joindre dans le cas o\u00f9 un risque imminent de d\u00e9versement existe ou si un tel incident se produit.<\/p>\n\n\n\n<p>Pour op\u00e9rer dans les eaux canadiennes, tous les navires-citernes de 150 tonnes brutes (c\u2019est-\u00e0-dire d\u2019environ 20 \u00e0 30 m\u00e8tres de long) et tous les navires de 400 tonnes brutes (c\u2019est-\u00e0-dire d\u2019environ 30 \u00e0 40 m\u00e8tres de long)<sup><a href=\"#citations\">[9]<\/a><\/sup> ou plus, de m\u00eame que toutes les installations de manutention des hydrocarbures doivent avoir une entente avec un organisme d\u2019intervention certifi\u00e9. L\u2019acc\u00e8s \u00e0 de l\u2019information pr\u00e9cise aide les intervenants \u00e0 prendre de meilleures d\u00e9cisions et \u00e0 agir plus rapidement au moment de l\u2019incident.<\/p>\n\n\n\n<p><strong>Informations pr\u00e9alables<br><\/strong>Le choix de la ou des techniques de nettoyage appropri\u00e9es pour r\u00e9pondre \u00e0 un d\u00e9versement d\u2019hydrocarbures (sur l\u2019eau ou le littoral) est bas\u00e9 sur des donn\u00e9es recueillies par le&nbsp;<a href=\"https:\/\/www.canada.ca\/fr\/environnement-changement-climatique\/services\/programme-urgences-environnementales\/centre-national.html\" target=\"_blank\" rel=\"noreferrer noopener\">Centre national des urgences environnementales<\/a>&nbsp;d\u2019Environnement et Changement climatique Canada et&nbsp;<a href=\"https:\/\/tc.canada.ca\/fr\/transport-maritime\/securite-maritime\/plan-national-preparation-matiere-prevention-intervention-environnementale\" target=\"_blank\" rel=\"noreferrer noopener\">les \u00e9quipes r\u00e9gionales d\u2019intervention pour la protection environnementale.<\/a>&nbsp;La collecte de donn\u00e9es pr\u00e9alables comprend l\u2019identification et la cartographie des zones sensibles, des habitats et des populations d\u2019animaux sauvages afin que les \u00e9quipes d\u2019intervention puissent obtenir des conseils scientifiques sp\u00e9cialis\u00e9s lors d\u2019une intervention.<sup><a href=\"#CITATIONS\">[15]<\/a><\/sup><\/p>\n\n\n\n<p>Les organismes d\u2019intervention recueillent \u00e9galement des donn\u00e9es sur la sensibilit\u00e9 des zones c\u00f4ti\u00e8res en collaboration avec les Premi\u00e8res Nations et les communaut\u00e9s locales en vue d\u2019\u00e9laborer des strat\u00e9gies d\u2019intervention adapt\u00e9es.<\/p>\n\n\n\n<p><strong>Cartographie du littoral<\/strong><br>Afin d\u2019identifier les zones \u00e9cologiquement sensibles et culturellement importantes le long du littoral, Environnement et Changement climatique Canada cartographie les c\u00f4tes canadiennes en captant des images du littoral, plus particuli\u00e8rement de la section comprise entre les laisses de mar\u00e9e haute et de mar\u00e9e basse.<\/p>\n\n\n\n<p>La cartographie du littoral fournit des renseignements cl\u00e9s sur les types de littoraux \u2013 sablonneux, vaseux, rocheux, falaises, battures, etc., \u2013 et les esp\u00e8ces sauvages qui s\u2019y trouvent. Dans ce cas de figure, l\u2019\u00e9volution du d\u00e9versement est surveill\u00e9e de pr\u00e8s au cas o\u00f9 il devient n\u00e9cessaire de d\u00e9ployer des mesures d\u2019intervention m\u00e9caniques. Toutes les installations de traitement des hydrocarbures et les navires commerciaux op\u00e9rant dans les eaux canadiennes paient une redevance annuelle \u00e0 l\u2019organisme d\u2019intervention avec qui ils ont pass\u00e9 une entente pour en couvrir les frais d\u2019op\u00e9ration.<\/p>\n\n\n\n<p><strong>Le principe du pollueur-payeur<br><\/strong>En vertu de la&nbsp;<a href=\"https:\/\/laws-lois.justice.gc.ca\/fra\/lois\/M-0.7\/\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur la responsabilit\u00e9 en mati\u00e8re maritime<\/a>, si un navire d\u00e9verse des hydrocarbures de quelque type que ce soit dans les eaux canadiennes, le pollueur est responsable de payer pour les co\u00fbts associ\u00e9s au nettoyage. Le propri\u00e9taire du navire, par le biais de l\u2019assurance dommages \u00e0 laquelle il est tenu de souscrire, constitue la premi\u00e8re source d\u2019indemnisation. Si les r\u00e9clamations \u00e9ligibles soumises exc\u00e8dent la limite de responsabilit\u00e9 du pollueur, une indemnisation suppl\u00e9mentaire peut \u00eatre demand\u00e9e aupr\u00e8s d\u2019<a href=\"https:\/\/clearseas.org\/fr\/deversement-hydrocarbures\/\" target=\"_blank\" rel=\"noreferrer noopener\">autres sources<\/a>&nbsp;financ\u00e9es par l\u2019industrie.<\/p>\n\n\n\n<p>L\u2019une de ces sources est la&nbsp;<a href=\"http:\/\/sopf.gc.ca\/?lang=fr\" target=\"_blank\" rel=\"noreferrer noopener\">Caisse d\u2019indemnisation des dommages dus \u00e0 la pollution par les hydrocarbures caus\u00e9e par les navires&nbsp;<\/a>\u2013 le fonds canadien pour la lutte contre les d\u00e9versements d\u2019hydrocarbures \u2013 financ\u00e9 par des redevances pay\u00e9es par les acteurs de l\u2019industrie maritime.
